These comprehensive Terms of Service govern all transactions and interactions with Alexandra Kavanagh Fine Art, including purchases of original artworks, commissioned pieces, and high-quality prints. Please review these terms carefully before engaging with our services.
Introduction and Acceptance of Terms
Alexandra Kavanagh Fine Art operates as a professional fine art business specializing in the creation and sale of original artworks, bespoke commissioned pieces, and premium art prints. Our services are delivered through multiple channels including our official website, direct client communications, gallery partnerships, and in-person consultations. We maintain the highest standards of artistic excellence and professional service delivery across all our offerings.
By engaging with any of our services—whether making a purchase, commissioning custom artwork, requesting consultations, or simply browsing our collections—you ("you," "client," or "customer") automatically agree to be bound by these comprehensive Terms of Service. This agreement creates a legally binding relationship between you and Alexandra Kavanagh Fine Art, establishing clear expectations and responsibilities for both parties throughout our business relationship.
Age Requirements
You must be at least 18 years of age to enter into any agreements with us. If you are under 18, you must have explicit written consent from a parent or legal guardian who will assume full responsibility for the transaction and any associated obligations.
Terms Updates
We reserve the right to update, modify, or revise these Terms of Service at any time without prior notice. Your continued use of our services after any such changes constitutes your acceptance of the new terms. We recommend reviewing these terms periodically.
These Terms of Service work in conjunction with our Privacy Policy and any specific agreements related to commissioned works or special projects. In the event of any conflict between these general terms and specific project agreements, the specific agreements shall take precedence for those particular transactions while these general terms continue to govern all other aspects of our relationship.
Products, Commissions, and Orders
Our product portfolio encompasses three distinct categories, each with specific terms and conditions. Original artworks represent unique, one-of-a-kind pieces created by Alexandra Kavanagh, ranging from paintings and drawings to mixed media works. These pieces are accompanied by certificates of authenticity and detailed provenance documentation. Art prints include limited edition reproductions and open edition prints, all produced using museum-quality materials and archival printing processes to ensure longevity and color fidelity.
Commission Process
Commissioned artworks follow a structured creative process designed to ensure client satisfaction while respecting the artistic integrity of the work. Initial consultations involve detailed discussions about concept, size, medium, timeline, and budget. A formal commission agreement outlines all specifications, payment schedule, and delivery expectations. Work begins only after receipt of the agreed deposit, typically 50% of the total commission fee.
Throughout the creation process, clients receive progress updates and may request minor adjustments during specific phases. However, major changes to approved concepts may result in additional fees or timeline extensions. Final approval is required before completion, and full payment must be received before artwork delivery or transfer of ownership.
Price Determination
All pricing is based on current market conditions, material costs, and artistic complexity. Prices are subject to change without notice, though quoted prices for specific inquiries remain valid for 30 days.
Payment Processing
We accept various payment methods including credit cards, bank transfers, and payment plans for higher-value pieces. Payment must be completed in full before shipment of purchased works or final delivery of commissioned pieces.
Order Management
We reserve the right to refuse, cancel, or modify any order for reasons including inventory limitations, pricing errors, suspected fraudulent activity, or inability to meet specific requirements.
Shipping Excellence
All artworks are handled and shipped professionally using high-quality packing materials and methods. Shipping costs, insurance, and estimated delivery timeframes are communicated clearly at the time of purchase.
Intellectual Property, Returns, and Liability
Intellectual property rights form a crucial foundation of our business operations and artistic practice. All artworks, designs, images, and creative content produced by Alexandra Kavanagh Fine Art remain the exclusive intellectual property of the artist and business until full payment is received and ownership is legally transferred to the purchaser. Copyright, reproduction rights, and any derivative work rights will remain the intellectual property of Alexandra Kavanagh Fine Art unless otherwise outlined in the contract . Unauthorized reproduction, distribution, or commercial use of our artworks is strictly prohibited and may result in legal action.
Original Artworks
Returns accepted only if item arrives damaged, defective, or significantly differs from description. All returns must be reported within 48 hours of delivery with photographic evidence.
Art Prints
Eligible for return within 14 days if unopened, unused, and in original packaging. Customer responsible for return shipping costs unless item was damaged or defective upon arrival.
Commissioned Works
Custom artworks are non-returnable due to their personalized nature. However, if final artwork significantly deviates from approved specifications, we will work to resolve the issue or provide appropriate compensation.
Our cancellation policy recognizes the different stages of the artistic and fulfillment process. For standard purchases, cancellations are accepted within 24 hours of order confirmation with full refund. Commissioned works may be canceled within 48 hours of order confirmation with complete refund minus any incurred material costs. After this period, deposits become non-refundable as work will have commenced, though we will work with clients to find mutually acceptable solutions when possible.
Limitation of liability provisions protect both parties while ensuring fair treatment. Alexandra Kavanagh Fine Art's liability is limited to the purchase price of the specific artwork or service in question. We are not liable for indirect, incidental, consequential, or punitive damages arising from the use, inability to use, or any delays related to our products or services. This includes but is not limited to lost profits, business interruption, or personal disappointment, except where prohibited by applicable law.
These Terms of Service are governed by the laws of the jurisdiction in which Alexandra Kavanagh Fine Art operates, and any disputes will be resolved in accordance with local legal procedures and requirements.
Contact and Dispute Resolution
Effective communication serves as the cornerstone of successful client relationships and prompt issue resolution. We maintain multiple channels for client support and encourage early communication to address any concerns before they escalate. Our commitment to customer satisfaction extends beyond the initial transaction to encompass the entire client experience, from initial inquiry through post-purchase support and beyond.
Direct Communication
For all inquiries, concerns, or disputes regarding orders, commissions, or these Terms of Service, please contact us directly through our official communication channels. We prioritize prompt responses and aim to acknowledge all communications within 24 hours during business days.
Amicable Resolution
We believe in resolving issues through open dialogue and mutual understanding. Our approach emphasizes collaborative problem-solving rather than adversarial procedures, working together to find solutions that respect both artistic integrity and client satisfaction.
Formal Procedures
While we strive to resolve all matters through direct communication, we respect your right to pursue formal legal action if necessary. We encourage exhausting collaborative resolution attempts before initiating legal proceedings, as this often leads to more satisfactory outcomes for all parties.
Our dispute resolution philosophy emphasizes transparency, fairness, and artistic integrity. When issues arise, we conduct thorough investigations, considering all relevant factors including order specifications, communication history, and applicable policies. We document all interactions and maintain detailed records to ensure consistent and fair treatment across all client relationships. Our goal is not merely to resolve immediate concerns but to strengthen long-term relationships and improve our services based on client feedback.
"We view every client interaction as an opportunity to demonstrate our commitment to excellence in both artistic creation and customer service. Your satisfaction and trust in our work represent the foundation upon which Alexandra Kavanagh Fine Art continues to grow and evolve."
These Terms of Service represent a living document that evolves with our business practices and legal requirements. We encourage clients to maintain copies of current terms for their records and to reach out with questions about any provisions. By fostering clear communication and mutual understanding, we create an environment where artistic vision and client satisfaction can flourish together, resulting in meaningful artwork and lasting relationships that extend far beyond individual transactions.
